The resolution, which includes the expansion of the territory covered by the TJSP and the need for a rapid assessment of jurisdiction in all regions of the state, provides for the empowerment of specific criminal courts with the competence to prosecute and try crimes for acts of a political nature. party of political violence, in accordance with articles 9-14 of Regulation 135/22, redacted by the National Corregedorie of Justice, on September 2 last year. The temporality of the measure and the establishment of the deadline for cooperation agreements are valid until January 5, 2023.
At the announcement of the decision, the President of the Court of São Paulo, Judge Ricardo Mayr Anafe, said that the Corregedoria-Geral da Justiça had proposed to send the draft to the Presidium “which is in accordance with Regulation 135/22, but without, after the creation of new judgments, which in São Paulo depend from the law.”
In accordance with a regulation signed by the National Inspector of Justice, Minister Luis Felipe Salomao, the Federal Court and regional courts must, by September 30, change the competence or make special decisions on violent crimes with political party motivation, including situations related to an association or a criminal organization and the police . The aim of this measure is to prioritize and expedite these trials by focusing the work of the judiciary on fighting crime more effectively.
According to the norm, acts of political party violence may be accompanied by physical or moral violence, including crimes against honor, and motivated by political, electoral or party considerations; ideological intolerance towards a diverse political spectrum; or inconsistency directed at the values and institutions of a democratic rule of law, “especially those related to the electoral process, the tenure of those elected, freedom of speech and the legitimacy of elections or their participants.”
