Thus, the temporal thesis suggests limiting the demarcation of indigenous lands to only those territories proven to be in indigenous possession on October 5, 1988, the date of the promulgation of the Constitution. The Indigenous Thesis, on the other hand, recognizes the rights of Indigenous Peoples as emerging, that is, prior to the state itself. It is important for the Indigenous Movement that the STF reject the deadlines as soon as possible, as this proposal is an incentive for traffickers, miners, loggers and land grabbers.

The Brazilian Constitution guarantees the rights to our territories, and only the proposal of a time frame already violates this Constitutional and Inheritance Law.
