Former Lava Jato prosecutor Carlos Fernando dos Santos Lima classified the PEC (proposed constitutional amendment), which could change the composition of the CNMP (National Council of Public Ministry) and give more influence to the National Congress, as “a legislative attempt to control politics.”

The meeting to be reviewed by the PEC yesterday was canceled by House President Artur Lear (PP-AL), but the topic remains on the agenda and should be resumed today.

It only asks who determines a significant part of the actions – this is justice itself, subject to many degrees of appeal. The control that CNMP exercises and should exercise is administrative only. In an interview with the Veja magazine website on Monday, Lyra argued for PEC approval to “slow down” and eliminate what he called “superiority” by prosecutors. whose function is to oversee and protect the fundamental principles and interests of society.

The PEC author, MP Paulo Teixeira (PT-SP), said that the proposed changes in the new wording would be enough to collect the votes needed to approve the opinion in the chamber.

Since this is a PEC, approval requires a qualified majority of three-fifths of the deputies in two rounds of voting – or 308 votes out of 513 deputies.

According to Paulo Teixeira, the changes were to be agreed at a meeting with ANPR (National Association of Republic Prosecutors), Conamp (National Association of Members of the Ministry of State) and US attorneys general. “We discussed these changes (yesterday) this morning, and they worked in the afternoon, but there was not enough time to discuss them with the benches. Therefore, the text will be put to a vote tomorrow, ”he said. “I think we will have votes for approval,” he added.

According to the deputy, two out of five category applications were accepted. For example, a CNMP inspector general will be appointed every two years from a five-fold list proposed by attorneys general: one from each region, all active, with the final choice alternating between the House and the Senate.

Acts of prosecutors and prosecutors can only be overturned by a judge, not by CNMP. Acts committed by fraudulent or fraudulent activities that violate functional duties will be investigated through disciplinary administrative proceedings and recognized by the judiciary.
