Martin Gugino: A 75-year-old Buffalo demonstrator has a fractured skull and can’t walk

“I am not free to explain at this time other than to confirm that his skull was fractured,” said Gugino’s lawyer, Kelly Zarcone. “Even though he hasn’t been able to walk, we can have a brief conversation before he gets too tired. He appreciates all the worries about him but he is still focused on the problem rather than himself.”

CNN hasn’t been able to talk to Gugino directly, but in his press statement, Zarcone delivered a message from him: “I don’t think it’s necessary to focus on me. There are many other things to think about besides me.”

Gugino is focused on getting better and he is still in rehabilitation, Zarcone told CNN on Tuesday.

“Except for something unusual and unexpected, I don’t expect much change at all this week,” he said.

Gugino was injured when two police officers pushed him back during protests against racism and police brutality on June 4. The video of the incident shows that he fell on the sidewalk and his head began to bleed when another officer walked past him.

Officers Aaron Torgalski, 39, and Robert McCabe, 32, each pleaded not guilty to second-degree attacks and have been released on their own without guarantees.

Based on the initial video, police issued a statement saying Gugino stumbled and fell, Buffalo Police spokesman Mike DeGeorge told CNN. The police then changed the statement and suspended the officers without paying and opened an investigation.
