The Central Administrative Court of the South Caucasus gave partial reason to Benfica in a dispute with the Portuguese Football Federation (FPF) and decided to cancel five games banned at the Estádio da Luz stadium that were applied by the FPF Disciplinary Council to the eagles in support of Organized Fan Groups (GOA) – fines retained so link to the partial reason.

“In accordance with the provisions of article 11, paragraph 3 of RD21 / 22, where the sanction applied at the time of the establishment of the fact differs from the sanction in force at a later time, the regime that is specifically more favorable to the defendant will always be applied. was convicted by final judgment “, can be read in the Sentence, to which A BOLA had access.

As a reminder, Benfica appealed to the Court of Arbitration for Sport (TAD), which was correct, and FPF later applied to the Central Administrative Court – South. With a complaint about an illegal appeal. Here are two excerpts:

“(…) Scientific judgment has confirmed the understanding that, by admitting that the aforementioned groups are in an illegal situation, and that this demonstrates, in accordance with the terms contained in the facts established by TAD, the behavior of the defendant that

confirms their support, we consider it necessary to conclude that – as indicated in the decision of the Disciplinary Board of 12.02.2019, referred to in the present case – the defendant is challenging the regulation of competition, placing him in the crisis a good name for it. “

“Proven facts show the organization, mobilization and cohesion of support groups called Red Devils (DV) and No Name Boys (NNB), but only with trademarks registered with the National Institute of Industrial Property, without adequate evidence. • registration as a GOA with the IPD (now APCVD) as required by Articles 14, paragraphs 1 and 2 of Law 39/2009. Proven facts also demonstrate that the defendant supports / facilitates / collaborates with groups called DV and NNB. “

“Demonstrated support for addressing DV and NNB cheerleaders, expressed in permission to introduce, install, use, remove choreographic materials – flags, banners, stripes – in support of the Club and with symbols and links to DV and NNB, which if you know that it is not so, and they were not the subject of the case at the time of the games, created as an association and registered with the Portuguese Institute of Sports and Youth, it can be concluded that the defendant disputes the regulation of the competition, believing his good name during the crisis, therefore, being one of the the largest clubs in the country, he does not respect the rules aimed at preventing violence in sports. “
