The National Council of Justice ordered the suspension social networks
two judges who shared publications of party-political content. The decision that was taken on Wednesday (26) was taken by Minister Luis Felipe Salomao and one of the first members of the council in this sense during election period
.
Marcelo Lima Buhatem, judge of the Rio de Janeiro Court, was one of the targets. In the decision, Salomao said that the judge is a repeat offender, as another episode is being investigated. “A solution that ensures the proper protection of a democratic constitutional state requires the suspension of the profiles of the magistrate,” he justified.
“In view of this, the staff of this National Corregedory carried out activities on the social networks of the aforementioned justice of the peace (publicly available), in which several other publications were found that theoretically violated the prohibitive norms applicable to the national judicial system,” the minister wrote in the ruling – he cites the example a note issued by the National Association of Judges, of which the judge is president.
In this, the association rejected insults made by former Deputy Roberto Jefferson (PTB) to Federal Supreme Court (STF) Minister Carmem Lucia and pointed to the journalist’s alleged crimes against the current chief executive, President Jair Bolsonaro (PL). , in the case of Venezuelan girls.
According to Bukhatem, the press professional had “clear intent to harm the President of the Republic, but she did not appear to have been criticized by segments of civil society, nor reprimanded by the legitimate.”
The CNJ Minister understood that “the content of the note basically suggests that the union took advantage of the deplorable episode involving Ming Carmen Lucia, which was widely reported in the press, to insert in the middle of the text a manifestation of support for the President of the Republic, currently a candidate for re-election.” The suspension will be posted on the judge’s Twitter and Facebook profiles.
Another judgment was against Judge Rosalia Guimarães Sarmento of the Amazonas Court of Justice. Her Twitter account will be banned.
Salomao said in her ruling that the judge posted content “in support of a certain candidate for President of the Republic while spreading negative content about another candidate, the current federal executive,” going so far as to “announce her intention to vote and call on her followers vote for the same candidate of your choice.”
In the decision, the minister singled out more than 70 publications of Rosalia from October 20 to 23 of this content. “You who are against this absurdity, vote 13 and help prevent the defendants from deciding whether to arrest or not,” is one of several examples that make up a lawsuit against a judge.
According to Salomao, both magistrates violated the rules of the Brazilian judiciary by creating posts of a party-political nature.
“The federal constitution, which prohibits a magistrate from engaging in partisan political activity (Article 95, I), has chosen the legal assets to be protected, and this justifies the restriction of conduct imposed on magistrates. The main protected legal asset is, of course, the Democratic rule of law. (… ) It is the effectiveness of a democratic rule of law that generates citizens’ trust in the judiciary,” the minister wrote.
