A obrigatoriedade da vacina contra o Covid-19 tem pautado diversas discussões político-ideológicas no território nacional e internacional, sendo uma questão de saúde publica que, para muitos, contrapõe a autonomia individual ao interesse coletivo e tensiona o modelo federativo de um Estado, um Estado, um Estado, no caso brasileiro. Nesse sentido, diversos embates, p. ex., entre a obrigatoriedade ou não da vacinação e entre a atribuição da União, Estados e municípios na pandemia, marcam o noticiário cotidiano.

Como se sabe, parte considerável dessas discussões no Brasil é devido à postura do governo federal e sua “base” ideológica na conjuntura pandêmica. Nesse contexto, o papel do Supremo Tribunal Federal (STF) tem sido fundamental para assegurar direitos fundamentais, sobretudo o interesse coletivo, eo modelo federativo brasileiro da Constituição de 1988. A respeito, o STF foi instado diversas vezes (p. ex. ADI n 6586, ADI n. 6587, ARE n. 1.267.879), quase sempre por partidos políticos e não raro por omissões do governo federal.

Formou maioria em prol da obrigatoriedade do passaporte vacinal para aqueles advindos do exterior que desembarcarem no Brasil, affirmando a necessidade de exigência do comprovante vacinal e quarentena, espelhando medida adotada em diversos países e que se mostrou essencial no combate ao vírus, por conter principalmente a disseminação de novas cepas. Com base nos julgamentos do STF voltados para a questão vacinal, as decisões buscam sopesar direitos individuais ao bem coletivo, pautando-se pelos mecanismos e justificativas constitucionais que ponderam direitos fundamentais em prol de um caráter decisório que concilia posicionamentos contrários que valoriza a saúde coletiva.

Consequentemente, afirmou-se que os direitos coletivos de vida e de saúde e das crianças devem sobrepor os de liberdades de consciência e de convicção filosófica; isso porque o Estado deve em situações excepcionais, como o contexto pandêmico, impor limites da autonomia individual em prol da preservação dos direitos fundamentais de terceiros, não autorizando que, p.ex., os pais por convicções próprias coloquem em risco dos a saúde , violando o Estatuto da Criança e do Adolescente (ECA).

No caso da pandemia isso também tem sido válido pelo STF para assegurar o direito à vida e minorar os impactos negativos da pandemia na federação, tudo sob o crivo da Ciência, cumprindo fielmente a Constituição de 1988.
